Terms and Conditions

Below we reproduce the terms and conditions we have asked customers/homeowners and trades people/artisans/service providers to sign/accept.

Terms and Conditions if joining as a customer/homeowner

1. You understand and agree that any ideas, initiatives, concepts, materials, downloaded, read by you or made known to you by the business and Internet website of 4CircleSolutions Ltd; remain the intellectual property of 4CircleSolutions Ltd. You will not use them to form the basis of any business venture in any other country. They will not be disclosed by you to third parties for the same purpose, without the specific consent of 4CircleSolutions Ltd.


2. You certify to the best of your knowledge, that any information you post on this site is accurate.


3. You certify and agree that you are using this system in a genuine effort to find trades people/service providers and not for any other purpose deemed by 4CirlcleSoultions Ltd. to be inappropriate.


4. You understand and agree that by posting a job on this site you
   
   * Are genuinely looking for either work to be carried out or an estimate to help you decide whether or not to do the work
   * Promise to reply to any trade company (registered on our site) that contacts you as a result of this job posting.
   * Are responsible for the Job as posted and its' details. You promise that all details are true and relevant.
   * Are responsible for removing the job from our website once it has been allocated or you have decided not to pursue it.



5. You understand that malicious posting of jobs (knowingly posting jobs that are not genuine, using false contact information) will be reported to the authorities and your IP address will be passed on to concerned parties



6. You understand and agree that we are not liable for and you will not hold us liable for the quality of any work/job/project undertaken by any trades person or trades people found through this service.


7. You understand and agree that any dissatisfaction with any work/job/project done can only be taken up with that trades person or trades people and will not be taken up with this service, its’ officers nor employees.


8. You understand and agree that any rating given by you for a service provided or job/work/project done, is a matter between you and the service provider/trades person. If there is a dispute regarding work done where the homeowner names a trades person and the trades person denies doing the work, the homeowner will provide all details about the job, name of person/people who did the work, their contact information, the work they did and the problem(s) encountered. The homeowner also agrees to let 4CircleSolutions pass their contact information to the trades person and the trades person will become responsible for contacting the homeowner to resolve the dispute within 1 week. Depending on receipt (or lack of receipt) of confirmation, 4CircleSolutions will decide whether or not any rating will remain and all parties agree that this decision is final and binding, including any action regarding removal of membership privileges


9. You understand and agree that you will use reasonable criteria and judgement when giving a rating to a service provider/trades person for a service provided or job/work/project done.


10. You understand and agree that you will not use the rating system as a means to air unsubstantiated grievances nor to gain financial advantages e.g. driving any previously agreed price, down.


11. You understand and agree that any jobs/work/projects that you post onto this system will remain there until you remove them or until we decide to remove them for ANY reason.


12. You understand and agree that any details of trades people or services providers, including contact information, obtained by you through this service, remain the intellectual material of this service and that you will not sell or give this information to other organisations but are welcome to pass them on without reward to other homeowners. .


13. You shall not provide copyrighted materials without authorisation, provide obscene or offensive material (e.g. pornographic), provide material whose nature and/or volume compromises the ability of 4CircleSolutions Ltd’s to serve our websites (instances including but not limited to unreasonable consumption of disk space, Internet link bandwidth, CPU, and memory usage, as determined by 4CircleSolutions LTD's staff), provide materials that are deemed by the government authorities as inappropriate or illegal. Any such government determinations will be binding on the customer, not 4CircleSolutions Ltd's


14. You understand and agree that “Spamming” or any type of unsolicited commercial or non-commercial email, is strictly prohibited, and your account may be suspended if you are found to be doing so.


15. You understand and agree that we reserve the right to remove any and all information that you have entered for ANY reason and specifically for system abuse. Abuse means trying to use the system in a non-reasonable manner e.g. giving trades people a poor rating without justifiable reason. 4CircleSolutions Ltd take no responsibility for any information loaded to our website by our customers. If it is brought to our attention, and we deem the material to be inappropriate, we will suspend the customer's service on our websites, until any illegal or inappropriate data is removed.


16. You understand and agree that you will fully indemnify 4CircleSolutions Ltd against liability (of any nature), which may befall 4CircleSolutions Ltd as a result of the customer’s illegal use of our services.


17. You understand and agree that 4CircleSolutions Ltd is not responsible for any interruption of service, and accept no liability for any loss of services, sales or any other form of loss.


18. You understand and agree that should there be a dispute of any kind, we have the right to the final say/decision in resolving the dispute. We undertake to use reasonable judgement in any dispute and indeed to refuse to arbitrate where disputes fall into the above categories.

Terms and Conditions if joining as a tradesperson / artisan / service provider

1. You understand and agree that any ideas, initiatives, concepts, materials, downloaded, read by you or made known to you by the business and Internet website of 4CircleSolutions Ltd; remain the intellectual property of 4CircleSolutions Ltd. You will not use them to form the basis of any business venture in any other country. They will not be disclosed by you to third parties for the same purpose, without the specific consent of 4CircleSolutions Ltd.


2. You certify to the best of your knowledge, that any information you post on this site is accurate.


3. We make several checks to ensure that the jobs posted are from genuine sources (email verification, telephone number and address checking) but you understand and agree that we have no way of ensuring requests made are totally genuine searches for trades people. Therefore, you understand and agree that we have made genuine efforts to ensure that jobs posted come from a genuine source. You accept that for any reason, should a job prove not to be genuine, you will not hold 4 CircleSolutions ltd liable and you will not be entitled to any refund. However 4CircleSolutions recognises that in some cases a job that was posted was posted maliciously and will re-credit you account where this is easily proven.



4. You understand and agree that once you have contacted the homeowner / job author it is entirely in their hands as to whether or not they proceed with their request.



5. You accept that you will not hold 4CircleSolutions liable for the 'seriousness' nor the intention or lack of intention of purchasing your services on behalf of the job author. We cannot guarantee you work.



6. You understand and accept that you are buying the homeowner contact information and not the promise of work. It is entirely between you and the job author whether or not this contact leads to any work.



7. If you have made reasonable effort to contact a job author without success and this must include email and telephone calls, You must write to us at member-support@findatradeinfrance.com with specific details regarding the job name, date posted, location and what contact efforts you made, 4CircleSolutions will investigate and if they deem the contact to be 'suspect' they will recredit your account.



8. In the event that 4CircleSolutions considers a credit to not be appropriate, and you wish to pursue the matter, 4CircleSolutions will provide the IP address and (where legally obliged to) the home address of the job author so that the trades person can pursue the matter as they see fit.



9. You certify and agree that you are using this system in a genuine effort to find customers/work and not for any other purpose deemed by 4CirlcleSolutions Ltd. to be inappropriate including passing on details of jobs posted by our homeowner members to other trades people who are not members of this service. Nor may you advertise your ability to find other tradespeople. You certify that your company covered by your registration will perform all works. If you join offering services that are clearly not covered by your registration/SIRET details and if 4CirlceSolutions deems your business is to provide job information to others (e.g. competitors of 4CircleSolutions Ltd. such as Job counselling services marketing agents for other trades etc; your membership will be terminated and no refund will be made due to the amount of work required to inform members of your error


10. You certify and agree that you are trading in the country where your advertisement appears, legally with all supporting documentation, accreditations, insurances and legal requirements of that country and that you are registered to offer all the services you display


11. You understand and agree that this service is not liable for and you will not hold this service liable for any ratings given by your customers found through this service.


12. You understand and agree that any dissatisfaction with any work/job/project done by you may only be taken up by the customer and is a matter between you and the customer only. Any dissatisfaction/complaint will not be resolved through this service, its’ officers nor employees.


13. You understand and agree that any rating given by your customer must be for a genuine service provided or job/work/project done and is a matter between you and the customer and you agree not to ask us to get involved in any ratings disagreements.


14. You understand and agree that any details, including contact information, obtained by you through this service, remain the intellectual material of this service and that you will not sell or give this information to other organisations nor individuals. You shall not provide copyrighted materials without authorisation, provide obscene or offensive material (e.g. pornographic), provide material whose nature and/or volume compromises the ability of 4CircleSolutions Ltd's to serve our websites (instances including but not limited to unreasonable consumption of disk space, Internet link bandwidth, CPU, and memory usage, as determined by 4CircleSolutions Ltd's staff), provide materials that are deemed by the government authorities as inappropriate or illegal. Any such government determinations will be binding on the customer, not 4CircleSolutions Ltd's.

16. You understand and agree that by clicking on submit, even if you do not proceed to pay, that we will retain your details as an inactive member and send you details of jobs (excluding contact information) to help you decide if you would like to join and that by doing so this is not considered as spamming but providing you with information that you want to see.


17. You understand and agree that we reserve the right to remove any and all information that you have entered for ANY reason and specifically for system abuse. Abuse means trying to use the system in a non-reasonable manner e.g. signing up as a customer in order to give yourself a good rating or offering services that you are not registered to offer. 4CircleSolutions Ltd take no responsibility for any information loaded to our website by our customers. If it is brought to our attention, and we deem the material to be inappropriate, we will suspend the customer's service on websites, until any illegal or inappropriate data is removed.


18. You understand and agree that you will fully indemnify 4CircleSolutions Ltd against liability (of any nature), which may befall 4CircleSolutions Ltd as a result of your illegal use of our services.


19. You understand and agree that 4CircleSolutions Ltd is not responsible for any interruption of service, and accepts no liability for any loss of services, sales or any other form of loss.


20. You understand and agree that should there be a dispute of any kind, we have the right to the final say/decision in resolving the dispute. We undertake to use reasonable judgement in any dispute and indeed to refuse to arbitrate where disputes fall into the above categories.


21. You understand and agree that any fee includes all features regarding advertising your details, your details being notified to our members who are looking for you, recommendations and emailing of new jobs posted but that we do not guarantee you will receive any job notifications, that this is dependent on homeowners posting jobs for your trades in your coverage areas but we do guarantee that any job posted that meets your criteria, will be emailed to you (notwithstanding a technical fault or anti blocking ISPs) within 2 hours of it being posted.


22. You understand and agree that all transactions are final and that no refunds are available, as services cannot be returned. If for any reason 4CircleSolutions decide to refund any monies/fees, An administration fee may become due, to cover bank and credit card charges. If you break any of these Terms and Conditions you will not be eligible for a refund. You understand that we do not consider ‘lack of jobs notified to you’ as a valid reason for a refund.


23. You understand that in accordance with European law regarding the provision of services that cannot be returned, you do not have the right to any refund. If you have any questions regarding this matter, please write to membership@findatradeinfrance.com . Cancelling your membership does not cancel your agreement to our Terms and Conditions.



24. You understand and agree that normally we are able to approve memberships very quickly with a few simple checks but that we may request that you provide documentation (e.g. chambre des metiers papers, telephone bills) in order to validate your membership details and registration. If you do not provide the requested documents and because of the time it takes to go through the validation, there will be a charge (made against your account credits) of 20 Euros. This charge will be offset against any refund that may be requested by you. If the requested papers are provided there will be no additional charge and your membership will be activated.



25. You unerstand and agree that should you wish to cancel your membership and that if you have any balance left in your account, that balance was may be made up of bonus amounts and is not necessarily equal to a monetary value. If you believe there is justification of a refund of money, you understand and agree that your account will first be subject to a retrospective charge for displaying your advert which remains free only to active members. This amount will be equivalent to 0.5 Euros per day or partial day of free advertising received and 1 Euro for every email sent to homeowners telling them you had joined. Then any bonus amounts received will be deducted from the remainder.



26. 4CircleSolutions Ltd reserves the right to alter these terms and conditions at anytime and without notice.


27. 4CircleSolutions Ltd reserves the right to alter the way it operates its' method of membership/advertising at anytime and without notice.
